# Terms of Service

These Terms of Service ("Terms") govern your access to and use of AutoEco (the "Service"), operated
by `[LEGAL ENTITY NAME]` ("we", "us", "our"). By accessing or using the Service, you agree to be
bound by these Terms.
## 1. Acceptance of Terms
By creating an account, accessing, or using the Service, you confirm that you have read,
understood, and agree to these Terms, our [Privacy Policy](privacy.md), and our
[Acceptable Use Policy](acceptable-use.md). If you do not agree, do not use the Service.
## 2. Description of the Service
AutoEco is a financial record-keeping and calculation tool for vehicle ownership. The Service
allows you to:
- Record the vehicles you own or are responsible for;
- Log fuel entries and expenses so that consumption and ownership cost can be computed from your own
data;
- See your **true cost per month**, **true cost per kilometer**, a category breakdown, and a
forward-looking forecast of what the vehicle will cost over a future period;
- Run financial scenarios (for example, the effect of a change in fuel prices) and ask questions
about your own figures through **Ask Your Car**;
- Export your data as CSV, and delete your account and data.
The Service is a **financial tool only**. It is not a vehicle diagnostic, inspection, mechanical
advice, or safety service. Nothing in the Service tells you whether a vehicle is safe or roadworthy,
and you must not rely on it for that purpose. Decisions about maintenance, repairs, or whether to
keep or replace a vehicle are your responsibility.
Figures that are projections or estimates are labeled as such throughout the Service. The
projections are extrapolations from your own recorded history and displayed assumptions; they are
not forecasts of future market conditions.
## 3. Accounts
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your credentials and for all activity
under your account.
- You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an
account.
- One person may not maintain multiple accounts to obtain repeated trials or to bypass plan limits
(see our [Acceptable Use Policy](acceptable-use.md)).
- You must notify us promptly at `[CONTACT EMAIL]` of any unauthorized use of your account.
## 4. Free Trial
- We may offer a free trial of a paid plan for a limited period, as described at sign-up.
- At the end of the trial, access reverts to the Free plan unless you have subscribed and not
cancelled before the trial ends.
- Free trials are limited to one per person. Creating multiple accounts to obtain repeated trials is
prohibited.
## 5. Subscriptions & Billing
- Paid plans are billed in advance on a recurring monthly basis through our payment processor,
Paddle. Historical subscriptions may be billed through Stripe.
- Subscriptions renew automatically unless cancelled. You may cancel at any time from Settings;
cancellation takes effect at the end of the current billing period, and you retain access until
then.
- Prices are stated on our pricing page and shown again at checkout. We may change prices with
reasonable advance notice; changes apply to subsequent billing periods.
- Applicable taxes (for example VAT) may be added based on your billing location.
- Where a one-time purchase is offered, it grants access to the top paid tier for as long as the
Service is offered, subject to the plan's fair-use limits shown in the product.
- Refunds are governed by our [Refund Policy](refund-policy.md).
## 6. Plans, Limits and Quotas
- Plan names, prices, vehicle limits, monthly expense limits, AI quotas and feature flags are
configured in the Service and shown on the pricing page and in Settings. We may change these;
changes apply going forward.
- Quotas are enforced **server-side**. Attempting to exceed a limit by manipulating the interface
is a breach of these Terms.
## 7. Your Data
- **You retain ownership** of the vehicle, fuel and expense data you enter.
- You can export your data as CSV at any time from Settings. You can delete your account and data
from Settings at any time.
- We do not sell your data and do not use your financial records for advertising.
- See our [Privacy Policy](privacy.md) for what happens to your data on deletion, including the
anonymized financial records we are required to retain for tax and accounting purposes.
## 8. Acceptable Use
You must comply with our [Acceptable Use Policy](acceptable-use.md) at all times, including the
prohibitions on scraping, bypassing quotas, and unauthorized automated access.
## 9. Intellectual Property
- The Service, including its software, design, branding and documentation, is owned by
`[LEGAL ENTITY NAME]` and protected by intellectual property laws.
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in
accordance with these Terms.
- You retain ownership of the data you enter. Feedback you provide may be used to improve the
Service without obligation to you.
## 10. Disclaimers
- The Service is provided "as is" and "as available", without warranties of any kind, express or
implied, including merchantability, fitness for a particular purpose, and non-infringement.
- **No warranty of mechanical condition or accuracy of calculations.** We do not warrant that the
Service will detect a mechanical fault, predict a repair cost accurately, or produce any
particular cost figure. Outputs depend entirely on the data you enter and the assumptions we
display alongside them.
- A demo account containing clearly-labeled synthetic sample data may be provided for evaluation.
Sample data is fictional and must not be treated as real financial records.
## 11. Limitation of Liability
To the maximum extent permitted by law:
- `[LEGAL ENTITY NAME]` shall not be liable for any indirect, incidental, special, consequential, or
punitive damages, including lost profits, lost data, or business interruption;
- our aggregate liability arising out of or relating to the Service shall not exceed the amount you
paid us in the twelve (12) months preceding the claim;
- nothing in these Terms excludes liability that cannot be excluded by law.
Nothing in these Terms limits your statutory rights as a consumer.
## 12. Termination
- You may stop using the Service and cancel your subscription at any time.
- We may suspend or terminate your access for breach of these Terms, non-payment, fraud, or abuse,
with notice where reasonably practicable.
- Upon termination your right to use the Service ceases. Export your data before terminating where
the account remains accessible. Sections that by their nature should survive (e.g. intellectual
property, disclaimers, limitation of liability) survive termination.
## 13. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the Service or
by email with reasonable advance notice. Continued use of the Service after the effective date of
changes constitutes acceptance of the updated Terms.
